TERMS AND CONDITIONS
INTERPRETATION
In these Terms and Conditions, the following words and phrases shall bear the following meanings:
· "REPS.TRAINING.EXERCISEREGISTER.ORG" is a product owned and operated by The Register of Exercise Professionals ("REPs") whose registered office is at 2 Kentish Buildings, 125 Borough High Street, London, SE1 1NT.
· "Services" means services provided by REPS.TRAINING.EXERCISEREGISTER.ORG and includes use of the website's resources and information.
· "User" means any person who accesses or uses REPS.TRAINING.EXERCISEREGISTER.ORG or any of the Services.
· "Training Provider" means any training provider who accesses or uses REPS.TRAINING.EXERCISEREGISTER.ORG or any of the Services.
· "Data" means data or information in any format, whether existing at the time of registration or not, which is communicated or transmitted to the User in accordance with a Service.
· "Personal Information" means Personal Data as defined in the Data Protection Act 1998 as amended.
USER RESPONSIBILITIES
1. By accessing or using any of the Services the User acknowledges and agrees to be bound by these Terms and Conditions.
2. The User agrees to fully comply with these Terms and Conditions, including the acceptance of liability as detailed in clauses 4 and 5.
3. Some Services require the User to obtain a unique user name and password. Each User may be allocated a unique user name and password for the authorised use of the User only. These are not transferable, and the User shall keep them strictly confidential and secure.
4. The User shall indemnify REPs against any unauthorised use of his/her user name and password, including use by a third party where the User has allowed or facilitated that third party to have access to any Data received in conjunction with any of the Services, however so received.
5. The User shall indemnify REPs against all costs, claims, demands or expenses incurred by or made against REPs or REPS.TRAINING.EXERCISEREGISTER.ORG as a result of any breach of these Terms and Conditions or howsoever arising.
TRAINING PROVIDER RESPONSIBILITIES
6. By accessing or using any of the Services the Training Provider acknowledges and agrees to be bound by these Terms and Conditions.
7. The Training Provider agrees to fully comply with these Terms and Conditions, including the acceptance of liability as detailed in clauses 9 and 10.
8. Some Services require the Training Provider to obtain a unique user name and password. Each Training Provider may be allocated a unique user name and password for the authorised use of the Training Provider only. These are not transferable, and the Training Provider shall keep them strictly confidential and secure.
9. The Training Provider shall indemnify REPs against any unauthorised use of the Training Provider user name and password, including use by a third party where the Training Provider has allowed or facilitated that third party to have access to any Data received in conjunction with any of the Services, however so received.
10. The Training Provider shall indemnify REPs against all costs, claims, demands or expenses incurred by or made against REPs or REPS.TRAINING.EXERCISEREGISTER.ORG as a result of any breach of these Terms and Conditions or howsoever arising.
11. The Training Provider agrees to be invoiced on a monthly basis for any fees occurred through the REPS.TRAINING.EXERCISEREGISTER.ORG including admin access, referrals and enhanced exposure. Invoices must be paid within 30 days of the date of issue.
12. The Training Provider shall ensure that REPs membership numbers are recorded for all attendees registered on the Register of Exercise Professionals that attend training listed through the facility.
13. The Training Provider shall submit details of CPD training attendees in excel format to online@exerciseregister.org detailing REPs Membership Number, Course Code, Course Start and End Date and CPD Points awarded within one month of the training end date. REPs are currently developing the functionality for Training Providers to log attendee details through the admin area of the REPS.TRAINING.EXERCISEREGISTER.ORG and the Training Provider agrees that when this functionality is activated all attendee data will be logged online by the training provider within one month of the training end date.
14. The Training Provider shall advise all attendees of qualifications that give entry to or a category of registration on REPs that upon completion they should submit hard copy evidence to the Register of Exercise Professionals so that database records may be amended accordingly. The Training Provider shall also advise that REPs will award 20 CPD points per category of qualification awarded and that points will only be recorded upon receipt of hard copy evidence.
15. The Training Provider agrees that Qualifications will only be listed on REPS.TRAINING.EXERCISEREGISTER.ORG if they have been through agreed verification processes.
16. The Training Provider agrees that CPD training courses will only be listed on REPS.TRAINING.EXERCISEREGISTER.ORG if they have been through agreed endorsement processes.
17. In using the admin area of REPS.TRAINING.EXERCISEREGISTER.ORG for any purpose the Training Provider agrees to be bound by the Training Provider Code of Practice available for download through the admin area.
18. The Training Provider agrees that failing to comply to any of these terms and conditions (both general and Training Provider specific) may result in the removal of organisation / course details from REPS.TRAINING.EXERCISEREGISTER.ORG.
PRIVACY POLICY
19. REPs takes the privacy of its Users seriously. It is committed to safeguarding the privacy of its Users.
LIABILITY
20. REPs, its agents or representatives shall have no liability whatsoever to the User for any direct, indirect or consequential loss or special loss or damage, cost or expense suffered or incurred by the User (whether arising in tort, contract or otherwise, and whether arising from the negligence, breach of contract, defamation, infringement of copyright or other intellectual rights) caused by use of REPS.TRAINING.EXERCISEREGISTER.ORG or from the negligence of its employees or agents or licensors, and whether asserted against REPs, REPS.TRAINING.EXERCISEREGISTER.ORG or against any third party in relation to the use of Services.
21. REPs does not make any representation or give any warranty, either express or implied:
· in relation to any information, goods or services offered, accessed or obtained through REPS.TRAINING.EXERCISEREGISTER.ORG;
· in relation to warrantees of title, non infringement of copyright or patent rights of others, merchantability, or fitness or suitability for any purpose;
· for the content, accuracy, integrity, lawfulness or otherwise of information on websites over which REPs has no control;
· as to the suitability of the information and data on REPS.TRAINING.EXERCISEREGISTER.ORG site for any particular purpose
· that the information and data on REPS.TRAINING.EXERCISEREGISTER.ORG site is free of infection by computer viruses or other contamination.
22. REPs and its agents or representatives do not endorse or in any respect warrant any third party products or services by virtue of any information, material or content referred to, or included on, or linked from or to REPS.TRAINING.EXERCISEREGISTER.ORG site or services.
23. REPS.TRAINING.EXERCISEREGISTER.ORG site and REPS.TRAINING.EXERCISEREGISTER.ORG Services do not purport to provide legal or other professional advice. REPs is not responsible for Users taking or refraining from taking actions on the basis of information provided by reps.training.exerciseregister.org or REPS.TRAINING.EXERCISEREGISTER.ORG Services.
24. Although every care is taken in the preparation of information supplied by REPS.TRAINING.EXERCISEREGISTER.ORG and REPS.TRAINING.EXERCISEREGISTER.ORG services, REPs is not responsible for any loss suffered as a result of any action taken or refrained from being taken as a result of any information contained in REPS.TRAINING.EXERCISEREGISTER.ORG site or supplied by REPS.TRAINING.EXERCISEREGISTER.ORG.
TRADE MARKS AND INTELLECTUAL PROPERTY
25. All rights in "REPs", " REPS.TRAINING.EXERCISEREGISTER.ORG " and other marks owned by REPs are reserved.
MISCELLANEOUS
26. REPs reserves the right to prohibit access by person(s) to the Services at its sole discretion.
27. REPs reserves the right to remove, alter, change or vary the Services at any time without notice.
APPLICABLE LAW AND JURISDICTION
28. The provision of the Services is governed by the Laws of England and shall be subject to the jurisdiction of the English courts.
VARIATION
29. REPs reserves the right to vary or amend these Terms and Conditions at any time without notice.
